Section 39A was introduced through a 2024 amendment to the Goa Town and Country Planning Act, 1974. It allows landowners to apply to have individual plots rezoned, and empowers the Chief Town Planner, with government and Board approval, to alter land use in regional and outline development plans. Land classified as green, orchard or no-development can be reclassified as settlement, opening it to construction, with a 30-day window for public objections after notification.

Those campaigning against it argue that this plot-by-plot approach bypasses the wider Regional Plan process and its broader public consultation, and that ecologically sensitive land has been converted as a result. Supporters of the provision argue that land-use plans drawn up decades ago do not always reflect present-day realities, and that the section allows zoning to be updated where development is of public importance. The debate is ongoing.
